CONDITIONS GENERALES ET PARTICULIERES DE LOCATIONqui sommes nous

OCCUPANCY

The premises can only be used for the purpose of holidays. The tenant must use the premises with care.  He must not sublet or hand over his rights described in the present contract to anybody else without prior consent by the agency. All professional activities are prohibited in the premises.
The tenant must abide by the interior rules and regulations pertaining to the building, and in particular, with respect to noise, washing lines, cleanliness, removal of household waste etc.
The accommodation is available for the dates and times fixed in the contract. The tenant agrees to accept the accommodation in the condition that
they are found on entry and complying to the description on the attached annex to the current contract.
On the day of arrival, the accommodation is available for occupancy from 5.00pm.  In the instance where the tenant arrives out of office hours he/she must notify the agency to organise his/her arrival.
On the day of departure, the accommodation must be vacated by 10.00am.  The accommodation must be left clean and tidy and the keys must be returned to the agency.
In the case where the accommodation is left dirty, any additional cleaning costs will be invoiced to the tenant. For every hour that the keys are not returned a penalty of 30 € will be invoiced.
If the number of occupants exceeds the number written on the contract, the agency can refuse the right of entry to the premises or reclaim a supplement.
The prices are fixed as follows: 60 €/person for a studio, 90 €/person for a one bed-roomed apartment, 120 €/person for a two bed-roomed apartment, 150 €/person for a three plus bed-roomed apartment.
No domestic pets can be brought into the accommodation without prior consent from the agency and at a supplement of 20 €/pet.

PRICES AND CONDITIONS OF PAYMENT

The holiday price includes agency fees, administration fees and rental.
The tenant has the possibility to purchase an insurance against any eventual cancellation. This can only be done when the signed booking form is returned with the deposit. No changes can be made after this point. Having paid the deposit, the tenant agrees to take possession f the premises at the date and time fixed on the contract and agrees to pay any out standing balance one month before the agreed arrival date.  If the booking is made less than one month before the arrival date then the complete balance must be made. Keys will be 305€ to 1500€, depending on the type of apartment. The length of the holiday duration can only be extended with agreement from the agency and will be charged pro rata based on the original holiday cost.

The security deposit, 305 € to 1500 €, is required to cover for any damage caused to the owners' belongings and/or the building in general. The deposit, paid directly to the agency, will be returned within two weeks of the end of the contract.
All installations, furniture and inventory must not deteriorate in condition any more than they would do under normal usage. At the end of this present contract, any items that are damaged, missing or extremely worn, must be replaced or paid for by the tenant.  This being the case, the legal representative will establish an invoice and any amount owing will be taken from the security deposit. If the security deposit does not cover in total the amount owing then the tenant will be obliged to pay the difference.

TENANT OBLIGATIONS AND INVENTORY CHECK 

When the tenant arrives, he/she is obliged to carry out a thorough check of the accommodation.  Any anomalies must be reported within 72 hours to the agency
otherwise they will not be taken into consideration.  Also, the tenant must agree to read the health and safety instructions provided on how to use properly the refrigerator.
During the period of occupancy, the tenant must accept and permit any major or urgent repairs to the accommodation and/or building.
At the end of the contract the tenant must replace all the furniture and inventory back to the place where they were found on entry into the premises.
The tenant agrees to leave the accommodation in a clean and presentable state.  This must include: cleaning floors, windows, mirrors, sinks, bathrooms, inventory, and refrigerator (defrosted and left open). All rubbish must be removed and includes: household waste, food, cleaning sponges etc.
The tenant must not throw anything in the toilets, bath, sinks etc that could cause an obstruction.  Any costs incurred due to this will be invoiced to the tenant.
On his/her departure, the tenant must ensure that the apartment is fully locked and the keys then returned to the agency.
If the keys are not returned then the cost of replacing the locks will be invoiced to the tenant and taken from the security deposit.

OBLIGATIONS OF AGENCY

The agency agrees to rent out the property as described and also to respect the conditions of the current contract.  If the agency cancels the current agreement and cannot find a suitable replacement property then the tenant has the right to request compensation.

CONDITIONS OF CANCELLATION
(CF. EXTRACT OF GARANTEES ADHESION N°92636-2361)

- If the tenant has not subscribed to the cancellation insurance then he/she will be liable to pay for the holiday in total, except in the case of force majeure.
- If the tenant has subscribed to the cancellation insurance then he/he must refer to the general conditions of the insurance.  In the instance where
there is no motive for cancellation or the reason for cancellation is not included in the policy then the deposit, 20% of the rent, must be paid.
Any cancellation must be done in writing and will only be accepted once the letter is received.
If the tenant does not take possession of the accommodation until after the contracted date, or leaves before the contracted end date, then he/she cannot claim compensation. If the premises are not occupied within 48 hours of the official contract date and without formal notice of a delay in arrival, the contract will considered to be cancelled and the tenant will be liable to pay the balance.

RESPONSABILITIES

The owner of the property and the agency decline all responsibility for risks, in particular fire, theft and water damage, to any personal objects belonging to the tenant.
Any personal effects belonging to the tenant are his/her own responsibility. They are not covered under any insurance policy belonging to the building, the owner or the agency.  The tenant must take out his/her own insurance policy to protect his/her own possessions, in particular to protect against theft of ski equipment stored in the ski lockers. Also, the tenant must have insurance for the property rented, as well as third party liability. At the request of the owner or the agency, the tenant must be able to provide justification of insurance cover. The owner and the agency decline all responsibility for any appeal that their insurance company might make against the tenant.

PRIVACY

The agent is authorised to use electronically, any information that is contained in the current contract. Conforming to the law of 6th January 1978,
the tenant has the right to access this information and can rectify any details.  This will be undertaken with agreement from both parties.

NATURAL AND TECHNOLOGICAL RISKS

Conforming to the law, 30th July 2003 which refers to the prevention of damages, and to the article L125-5 belonging to the environment code of conduct,
any tenants of property that are situated in zones covered by a risk (Technological or Natural) protection plan which can be either foreseeable, predictable or approved, or that are situated in a zone where there is seismic activity as defined by a decree from the state, must be forewarned by the agent.
Due to the nature of our holiday rental business, CIS IMMOBILIER, has available for all its clients, the legal texts, a risk assessment for each commune
and plans indicating areas at risk.  These have been provided by the local government office for the Savoie department.
